摘　　要：基于2009—2022年中国内地277个地级市面板数据,运用中介效应模型与空间杜宾模型,实证检验知识产权保护对数字产业创新的影响机理与空间效应。结果表明:知识产权保护正向赋能数字产业创新,这一结论经过稳健性检验后依然成立。异质性检验结果表明,知识产权保护对大规模城市数字产业创新的影响更为显著。中介作用机制显示,知识产权保护可以通过优化创新资本配置、降低信息披露成本、营造良好自主研发环境3种途径赋能数字产业创新发展。空间杜宾模型估计结果显示,知识产权保护不仅能够正向赋能本地区数字产业创新发展,而且对邻近地区数字产业创新发展发挥空间溢出效应。结论可为充分发挥知识产权保护对数字产业创新的赋能效应提供经验证据。As a strategic and fundamental industry supporting economic development,the digital industry has increasingly highlighted its supporting role in economic and social development and has become an important support for the development of the digital economy.At present,a new round of scientific and technological revolution and industrial transformation has reshaped the global competition landscape,and competition around the Internet,cloud computing,big data,artificial intelligence,quantum computing and other digital industries has become increasingly intense.In this context,the Chinese government has been endeavoring to"accelerate the implementation of innovation-driven development strategy"and"build an internationally competitive digital industrial cluster".As the source of industrial innovation-driven development,intellectual property rights are the exclusive rights of intellectual labor created in social practice.Strengthening the protection of intellectual property rights can provide a solid legal shield for Chinese innovation subjects and the innovation and development of digital industry.The comprehensive implementation of intellectual property protection can effectively increase the severity of the punishment of intellectual property infringement and illegal acts,improve the comprehensive intellectual property management system,open up the whole chain of intellectual property creation,application,protection,management and service,and create a good legal environment for the innovation and development of the digital industry.Then,how can intellectual property protection promote the development of digital industry innovation?Is there a spatial spillover effect between them?The answers to the above questions are of great significance for China to seize the opportunities for the innovation and development of the digital industry,promote the construction of a modern industrial system and effectively implement the innovation-driven development strategy.On the basis of the panel data of 277 prefecture-level cities in
