摘　　要：文化法律体系是由文化法所构成的规范体系。建立健全文化法律体系,既是全面推进依法治国、建设法治中国的必然要求,也是在新的起点上继续推动文化繁荣、建设文化强国的必由之路。改革开放以来,党领导的文化法律体系建设,与法治中国和文化强国建设同步推进,大致经历三个鲜明的发展阶段,即文化法律体系建设的奠基起步阶段(1978—1991年)、探索推进阶段(1992—2011年)、形成发展阶段(2012年至今),初步建立涵括“文化价值法、文化遗产法、公共文化服务法、文化产业与文化市场法、文化传播与文化交流法”五大内容板块的基本框架。面向未来,必须深入贯彻落实习近平法治思想、习近平文化思想,深刻把握“两个结合”,立足法治中国和文化强国建设的现实需要,在党的领导下不断推动文化法律体系的发展完善。The cultural legal system is a normative legal framework composed of cultural laws.Establishing and improving the cultural legal normative system is not only an inevitable requirement for advancing law-based governance and building the rule of law in China,but also an essential path to continue promoting cultural prosperity and building a cultural power from a new starting point.Since the reform and opening-up,the construction of the cultural legal system led by the Communist Party of China has progressed in tandem with building the rule of law in China and China as a cultural power.It has roughly gone through three distinct evolution stages:the foundational and initial stage of cultural legal system construction(1978—1991),the exploratory and advancing stage(1992—2011),and the formative and developmental stage(2012 to present).A basic framework has been preliminarily established,encompassing five major content areas:cultural value law,cultural heritage law,public cultural service law,cultural industry and cultural market law,and cultural dissemination and cultural communication law.Looking to the future,it is essential to thoroughly implement Xi Jinping Thought on the Rule of Law and Xi Jinping Thought on Culture,deeply grasp the"Two Combines",base efforts on the practical needs of building the Rule of Law in China and building China as a Cultural Power,and continuously promote the development of the cultural legal system under the leadership of the Communist Party of China.
