摘　　要：完善党的自我革命制度规范体系,需不断推进纪检监察体制改革。当前,深化纪检监察体制改革需上升至党内法规与国家法律衔接协调层面,聚焦纪检监察机关违纪违法查处机制。现有违纪违法一体化查处机制存在“纪法界限不清”、审查调查措施杂糅、监察调查活动性质不明以及“法法”衔接下“以审判为中心”理念未得凸显的问题。二元化查处机制构思未能化解一体化查处机制下“纪法界限不清”的问题,忽视了审查调查权限的合理配置。基于现有违纪违法查处机制面临的困境,在立案阶段应采取三元化立案模式,在审查调查阶段采用“纪政刑”三分流机构协同查处机制构思,以建立三元化违纪违法查处机制,推进完善党的自我革命制度规范体系。To improve the Party's institutional framework for self-reform,it is essential to continuously advance the reform of the disciplinary inspection and supervision system.At present,deepening this reform must be elevated to the level of coordinating intraparty rules and regulations with state laws,with a focus on refining the mechanisms for investigating and addressing violations of discipline and law within disciplinary inspection and supervision authorities.The existing integrated mechanism for handling violations of discipline and law faces several challenges:an"excessive integration of disciplinary and legal norms",the overlapping of review and investigative measures,ambiguities in the legal nature of supervisory investigations,and the insufficient emphasis on the"trial-centered"principle under the coordination of legal systems.Proposals for a dual-track investigation mechanism have failed to resolve the issue of"excessive disciplinary-legal integration"inherent in the integrated system while neglecting the rational allocation of investigative authority.In light of these institutional dilemmas,a tripartite case-filing model should be adopted at the initiation stage,coupled with a"disciplinary-administrative-criminal"tripartite collaborative investigation mechanism during the review and investigation stage.This approach aims to establish a three-dimensional framework for investigating and punishing violations of discipline and law,thereby advancing the refinement of the Party's self-reform institutional system.
