摘  要:监察委员会的组织性法律保留问题较为复杂。虽然《立法法》增加了监察委员会“产生、组织和职权”的规定,拓宽了宪法规定的保留范围,但并没有明确监察法规能否规定监察组织事项。这实际上回避了监察机关是否享有一定组织权的问题。基于监察委员会在权力来源、组织结构等方面的特质,党内法规也涉及监察组织领域,传统法律保留原则的局限性就显露出来。因此,既要动态理解宪法和《立法法》的相关条款,明确监察机关组织权的规范依据,又要从监察体制改革的政治定位和机构编制权的实践出发,反思法律保留理论。The issue of legal reservation concerning the organizational aspects of supervisory commissions presents considerable complexity.Although the Legislative Law has incorporated provisions regarding the"establishment,organization,and authority"of supervisory commissions,thereby expanding the scope of reservation stipulated by the Constitution,it remains unclear whether supervisory regulations may address organizational matters.This essentially sidesteps the fundamental question of whether supervisory organs possess autonomous organizational authority.Given the distinctive characteristics of supervisory commissions in terms of power sources and organizational structure,coupled with the involvement of intraparty rules and regulations in supervisory organizational domains,the limitations of the traditional legal reservation principle become apparent.Therefore,it is imperative to both dynamically interpret relevant constitutional provisions and clauses in the Legislative Law to clarify the normative basis for supervisory organs'organizational authority,and to re-examine the theory of legal reservation through the dual lenses of the political orientation of supervisory system reform and the practical implementation of institutional establishment authority.
