摘　　要：志愿服务立法是推动志愿服务向组织化、专业化、规范化和高质量发展的重要举措和必然要求。域外志愿服务立法实践主要集中在志愿者权益保护与激励、应急志愿服务法律完善以及志愿服务监督等方面。我国志愿服务立法主要以志愿者、志愿组织、志愿服务对象以及志愿活动为主体进行实践。当前我国志愿服务立法面临体系结构不完善、涵盖内容不全面、立法形式单一化等问题。未来,我国志愿服务立法需实现立法系统化、全面化和形式多样化,构建多层次立体化法律体系;立法全面化,明晰志愿服务的范围和主体,做到全面覆盖无遗漏;形式多样化,运用多元手段多措并举进行志愿服务法律建设,为我国志愿服务高质量发展提供坚实的法制保障。Legislation on voluntary service is an important measure and inevitable requirement for the organized,professional,standardized and high-quality development of voluntary service.The legal construction of voluntary service outside the region mainly focuses on the protection and incentive of volunteers'rights and interests,the improvement of emergency voluntary service laws,and the supervision of voluntary service.The legislation on voluntary service in China mainly focuses on volunteers,volunteer organizations,voluntary service recipients,and voluntary activities.At present,China's voluntary service legislation is facing substantive problems such as incomplete system construction,incomplete coverage,and a single legislative form.In the future,China's legislation on voluntary service needs to achieve legislative systematization,comprehensive and precise legal construction,build a multi-level and three-dimensional legal system,comprehensively legislate,clarify the scope and subject of voluntary service,and achieve a comprehensive summary without omission;Diversified forms and the use of multiple means and measures to carry out legal construction of voluntary service,providing a solid legal guarantee for the high-quality development of voluntary service in China.
