我国社区体育软法之治的困囿审视与路径优化

摘　　要：运用文献资料法、逻辑分析法等研究方法,基于对软法的相关概念及其特征的厘清,分析软法之于社区体育治理的耦合性和价值,且审视软法在社区体育治理中可能面临的困囿,并据此提出优化路径。研究发现,软法在社区体育治理面临的困境包括:类型及数量的相形见绌,理念或流于形式,缺乏配套的机制以及泛化的裁决标准。提出:健全完整和有序的创制程序,调动各主体的参与,完善保障与监督机制,注重软硬法的协同治理。Soft law has significant value efficacy and unique advantages in community sports governance in our country,to fully promote the implementation of soft law in community sports governance and the combination of the two is very important.Based on summarizing the concepts and characteristics of soft law,this paper analyzes the coupling and prominent advantages of soft law and community sports governance by using the methods of literature and logical analysis.This paper examines the difficulties that soft law may face in the implementation of community sports governance,and puts forward the targeted optimization path accordingly.The study shows that the value advantage of soft law is manifested in the flexibility of its governance mode,the diversification of governance subjects and the non-coercive effectiveness of governance.Soft law in the implementation of community sports governance is faced with such problems as the type and quantity of soft law dwarfing,the concept of soft law governance or mere formality,the lack of supporting mechanism,and the generalization of soft law ruling standards which easily lead to the decline of effectiveness.In order to solve the above challenges,specific measures should be taken to improve the integrity and order of soft law creation procedures,mobilize various subjects to participate in soft law governance,improve the protection and supervision mechanism of soft law,pay attention to the coordination of soft law and hard law governance,so as to ensure the implementation of soft law in China's community sports governance.
