算法推荐模式下“避风港规则”的适用困惑及完善建议

摘　　要：平台对于算法推荐技术的运用具有自身价值选择的内在逻辑,技术中立的免责事由在此情形下很难得到司法认同。同时,根植于避风港规则的“通知-删除规则”在新型技术的冲击下应该得到进一步的解释和升级运用。智能算法推荐模式下,算法推荐并不等同于主动推荐,但承认算法推荐方式改变了现有的法律适用标准,应肯定网络服务提供者具有更高的信息管理能力,合理扩大“必要措施”的范围,设立版权过滤义务。The platform's application of algorithm recommendation technology has its own intrinsic logic of value selection,the technology-neutral exemption is difficult to obtain judicial recognition in this case.At the same time,the"notice-remove rule"rooted in the safe harbor rule should be further interpreted and upgraded under the impact of new technologies.In the intelligent algorithm recommendation mode,algorithm recommendation is not equal to active recommendation,but it should be recognized that the algorithm recommendation mode changes the existing legal application standards.It is more reasonable to affirm that Internet service providers have higher information management capabilities,reasonably expand the scope of"necessary measures",and set up copyright filtering obligations.
