迈向碳中和的区域协同立法研究

摘　　要：迈向碳中和的区域协同立法旨在通过协同立法的方式,明确碳中和目标、措施、责任和保障机制,为区域内各部门、企业和公众提供明确的行动指南和法律保障,进而实现碳中和目标。基于对我国区域碳中和立法的实践分析,发现我国在碳中和领域立法,各区域间利益分配不一致,各主体动力不足,再加之区域协同立法程序不健全,导致难以通过协同立法保障碳中和目标实现。为了通过协同立法实现区域碳中和,应当在因地制宜原则、统筹兼顾原则、协商共识原则下,构建区域协同立法体系。具体而言,由多元主体进行广泛调研,共同制定区域协同立法计划;完善立法专家人才库,构建区域立法机构协同机制;健全立法审查和评估机制等,为迈向碳中和的区域协同立法提供保障。Regional collaborative legislation toward carbon neutrality aims to clarify the goals,measures,responsibilities and safeguard mechanisms of carbon neutrality through collaborative legal frameworks,providing clear action guidelines and legal assurances for regional departments,enterprises,and the public,thereby advancing the achievement of carbon neutrality.Based on an analysis of China's regional legislative practices in carbon neutrality,this study identifies challenges such as disparities in interest distribution among regions,insufficient motivation of stakeholders,and inadequate regional collaborative legislative procedures,all of which hinder the realization of carbon neutrality goals through collaborative legislation.To address these issues,a regional collaborative legislative system should be established under the principles of adapting to local conditions,holistic planning,and consensus through consultation.Specific measures include conducting extensive research by multiple stakeholders to jointly formulate regional collaborative legislative plans,enhancing the legislative expert database,building collaborative mechanisms among regional legislative bodies,and improving legislative review and evaluation mechanisms.These steps will provide institutional support for advancing regional collaborative legislation toward carbon neutrality.
