摘　　要：在推进中国式乡村治理现代化进程中,更好地发挥村规民约的治理效能是党和政府的鲜明主张。作为健全和创新党组织领导下自治、法治、德治相结合的现代基层社会治理机制的重要形式,村规民约具有广阔的应用价值和作用空间。然而,认识上的误区、村规民约自身建设和运行中的问题,让“治村宝典”沦为“墙上制度”,运用村规民约“治村”的传统优势未能得到发挥。当前应从理念、机制和实践层面对村规民约进行结构性与系统性完善,使其在推进中国式乡村治理现代化进程中扮演更重要的角色并承担应有责任。理念层面,要深刻把握村规民约发展中的变与不变,将村规民约稳定性的优势和变动性的灵活相结合,实现稳定性和变动性共生共存;机制层面,要以制定(修订)、实施、评估反馈和保障为核心要素与主要环节,再造适应调适模式的村规民约运行机制;实践层面,应从提升常态治理效能、增进乡村风险治理韧性、增强防止返贫效果等方面着力,运用村规民约赋能中国式乡村治理现代化。In the process of promoting the modernization of Chinese-style rural governance,it is the clear proposition of the Party and the government to give better play to the governance efficiency of village regulations.As an important form of modern grass-roots social governance mechanism combining autonomy,rule of law and rule of virtue under the leadership of sound and innovative party organizations,village regulations have broad application value and space to play a role.However,the misunderstanding of understanding(the"outdated theory"and"useless theory"of the village regulations),and the problems in the construction and operation of the village regulations have reduced the"village rule book"to a"wall system",and the traditional advantages of using the village regulations to"govern the village"have not been brought into play.At present,the structural and systematic improvement of village regulations should be carried out at the level of concept,mechanism and function,so that it can play a more important role and assume due responsibilities in the process of promoting the modernization of Chinese-style rural governance.At the concept level,the changes and invariability in the development and evolution of village regulations should be deeply grasped,the advantages of stability of village regulations should be combined with the flexibility of variability,and the coexistence of stability and variability should be realized.At the mechanism level,we should take the formulation(revision),implementation,evaluation,feedback and guarantee as the core elements and main links,and rebuild the operation mechanism of village regulations that adapt to the adjustment mode.At the functional level,we should focus on improving the efficiency of governance,improving the resilience of rural risk management,and enhancing the effect of preventing the return to poverty,and use village regulations to empower the modernization of Chinese-style rural governance.
