摘　　要：当前我国侵害知识产权违法案件多是以行政处罚告终,刑事制裁手段相对缺位,案件处理存在实体及程序上严重不足。为消除追责盲区,打破“以罚代刑”“有案不移”怪圈,需要推进行刑双向衔接制度的完善。但目前却存在沟通机制未能发挥有效作用、反向衔接机制重视不足以及检查意见发而不回的问题。其原因是我国采用行刑规范分立路径、涉及行政执法部门繁多,阻碍了衔接机制的有效运转。为此,应当以综合履职模式为指引,通过设置知识产权内设部门,优化行刑衔接渠道,以检察机关的监督职能为抓手,促进行刑双向衔接机制的互联互通。At present,most cases of infringement of intellectual property rights in our country end in administrative punishment,criminal sanctions are relatively absent,and there are serious deficiencies in the entity and procedure of case handling.In order to eliminate the blind spot of accountability and break the vicious circle of“substituting punishment with punishment”and“not moving the case”,it is necessary to promote the perfection of the two-way connection system of execution.However,at present,there are some problems such as the communication mechanism failing to play an effective role,the reverse cohesion mechanism not paying enough attention and the inspection opinions not being returned.The reason is that our country adopts the separation of execution standards and involves many administrative law enforcement departments,which hinders the effective operation of the cohesion mechanism.To this end,we should take the comprehensive performance mode as the guide,optimize the execution connection channels by setting up intellectual property departments,and promote the interconnection of the execution two-way connection mechanism by taking the supervision function of the procuratorial organ as the starting point.
