摘　　要：“双碳”目标的实现需要生产端与消费端的协同发力,在以碳普惠制推动消费端个体减排的实践中,个人碳账户通过记录与量化将个人碳排放量转化为个人碳资产,成为激励公众低碳生活的重要工具。纵观个人碳账户运行机制,社会公众的参与认知与意愿是基础,涉碳信息数据的安全问题是关键,碳账户促进碳市场融合是目标。基于此,个人碳账户建设的法律构造应以信息传递与合理授权充分尊重碳主体的知情权与选择权,以技术与法律规制涉碳敏感信息的有限利用与隐私泄露,以科学统一的核算与监管手段促进碳市场走向融合,从而确保个人碳账户在“双碳”目标指引下的创新发展与功能实现。The achievement of the "dual carbon" goals requires the joint efforts of both production and consumption ends. In the practice of promoting individual carbon emission reduction on the consumer side through the carbon inclusive system, personal carbon accounts transform personal carbon emissions into personal carbon assets through recording and quantification, becoming an important tool to encourage the public to live a low-carbon life. Looking at the operation mechanism of personal carbon accounts, the participation awareness and willingness of the public are the foundation, the security of carbon-related information data is the key, and the promotion of carbon market integration is the goal. Based on this, the legal construction of personal carbon account construction should fully respect the right to know and the right to choose of carbon subjects in information transmission and reasonable authorization, use limited utilization and privacy disclosure of carbon sensitive information with technical and legal regulations, and promote the integration of the carbon market with scientific and unified accounting and regulatory methods, thereby ensuring the innovative development and functional realization of personal carbon accounts under the gui-dance of the dual carbon goals.
