摘　　要：随着互联网时代的到来,网络犯罪成为司法机关重点关注和打击的领域。在刑法学视域下,帮助信息网络犯罪活动罪的过度扩张适用不仅不当限缩了其他罪名的适用空间,更导致了“同案不同判”的司法困境。其中,妥善处理该罪与“掩隐罪”的竞合关系,是有效规制帮信罪适用的关键路径。从构成要件理论出发,“掩隐罪”因其并非对正犯实行行为的加功,故与构成要件结果之间缺乏因果性协力。基于罪刑均衡原则,应当从行为方式与保护法益的实质差异入手,依据最小从属性理论中的因果性协力标准,对两罪的竞合关系进行类型化界分与认定。With the advent of the internet era,cybercrime has become a key area of focus and crackdown for judicial authorities.From the perspective of criminal law,the excessive expansion of the application of the crime of assisting information network criminal activities not only inappropriately limits the application space of other crimes but also leads to the judicial dilemma of“different judgments for the same case.”Among these,properly handling the concurrence relationship between this crime and the crime of covering up or concealing proceeds of crimes and the gains derived therefrom is a crucial path to effectively regulating the application of the crime of assisting information network criminal activities.Starting from the theory of constitutive elements,the crime of covering up or concealing proceeds of crimes and the gains derived therefrom lacks causal contribution to the constitutive result because it does not contribute to the perpetrator’s act.Based on the principle of proportionality between crime and punishment,the concurrence relationship between the two crimes should be typologically defined and identified according to the causal contribution standard in the minimal subordination theory,considering the substantive differences in behavioral methods and protected legal interests.
