摘 要:域内外在气候变化司法应对的具体路径上存在差异,域外“权利本位”的气候变化应对路径并不适合我国国情。我国气候变化司法应对路径的确定,应通过诉讼标的理论对案件类型进行概念区分,并考虑我国公益诉讼与私益诉讼并行的诉讼构造以及环境公益诉讼“去实体化”的特质。在此基础上,可将气候变化诉讼案件区分为气候环境公共利益案件、涉气候变化案件两类,前者包括气候环境行政公益型诉讼、气候环境司法审查型诉讼,后者则涵盖侵权类诉讼、合同类诉讼及其他关涉私益的诉讼。There are differences in the specific ways of climate change judicial response within and outside the domain,and the"rights-based"climate change response path outside the domain is not suitable for China's national conditions.To determine the path of local judicial response to climate change,we should distinguish the concepts of"climate and environmental public interest cases"and"climate change related cases"through litigation standard theory,and consider the parallel litigation structure of public interest litigation and private interest litigation in China and the characteristic of"dematerialization"of environmental public interest litigation.On this basis,climate change litigation cases can be divided into climate environment public interest cases and climate change related cases.The former includes climate environment administrative public interest litigation and climate environment judicial review litigation,while the latter covers tort litigation,contract litigation and other litigation involving private interests.
