论基层社会治理现代化中的乡贤调解

摘　　要：作为多元化纠纷解决机制的有机组成部分,乡贤调解是基层社会治理现代化中的重要力量。乡贤在所处社会网络中居于枢纽位置,“德望”型乡贤、“能人”型乡贤和“专业精英”型乡贤构成乡贤的主要类型,其各自独到的内在规定性分别塑造了该群体在基层社会治理中的比较制度能力。乡贤在调解中具有特定的解纷技巧,体现了基层解纷实践的基本规律。由乡贤调解的复合型功能所决定,乡贤调解从濡化、抚慰、感召等多个层面共同推进了基层民主法治建设。未来,我们应当在理论体系建设、自治规范建设、情理法整合机制建设、人民调解员的组织队伍建设等维度对乡贤调解助力基层社会治理创新的方案展开积极的探索,持续推进新时代以“枫桥经验”为典型代表的社会治理机制的现代化转型。As an organic component of diversified dispute resolution mechanism, the mediation by local elites is an important force in the modernization of grassroots social governance. Local elites occupy a pivotal position in their social network, the type of virtue and prestige, the type of capability, and the type of professionalism constitute the main types of local elites, and their unique internal regulations respectively shape the comparative institutional capabilities in grassroots social governance. In the process of mediation, local elites has specific working technics that reflect the basic laws of grassroots dispute resolution practice. Determined by its comprehensive institutional functions, the mediation by local elites jointly promotes the construction of grassroots democracy and the rule of law from multiple levels such as nurturing, comforting, and inspiring. In the future, we should make efforts to actively explore solutions for optimizing innovation in the grassroots social governance through the mediation of local elites in the construction of theory system, autonomous norms system, the mechanism of emotion, reason and law, and the organization of people's mediators, thus continuously promoting the modernization transformation of social governance mechanisms typically represented by the “Fengqiao Experience” in the new era.
