摘  要:国际规制合作具有削减边境后壁垒和提高规制一致性的制度价值,因而成为备受各国关切的全球治理议题。规制合作起源于国内行政法,经过APEC和OECD等国际组织助推,逐渐在国际经贸协定中得到制度化。规制合作的演化过程趋势体现了对良好规制实践的推崇,在规则设计中体现了实验主义治理模式的特点。区域贸易协定中达成的规制合作成果在提升规制质量的同时,也对多边主义框架产生影响。因此,通过区域贸易协定途径推进规制合作的合法性与可行性值得关注。我国的国内法和已缔结的经贸协定表达了接纳规制合作的意愿。结合中国推进涉外法治建设的现实需要,我国可在国际和国内两个层面审慎移植良好规制实践理念,优化规制合作制度设计。International regulatory cooperation holds institutional significance in reducing behind-the-border barriers and enhancing regulatory coherence,thus emerging as a crucial global governance concern.Originating from domestic administrative law,with the promotion of international organizations such as APEC and OECD,regulatory cooperation has been legalized within international economic and trade agreements.The evolution of regulatory cooperation reflects a growing emphasis on procedural coherence,with good regulatory practices as the fundamental principles,and embodying the characteristics of experimental governance.While recent developments in regulatory cooperation by regional trade agreements have enhanced regulatory quality,they also impact the multilateral framework.Therefore,the legitimacy and feasibility of promoting regulatory cooperation through regional trade agreements require further attention.China’s domestic regime and the economic and trade agreements have embraced the elements of regulatory cooperation.In light of the need to advance the rule of law in foreign affairs,China may prudently transplant the rules of good regulatory practices and refine regulatory cooperation regimes with the experimental governance framework.
