摘　　要：CPTPP非商业援助条款的不利影响和损害规则在规制对象、规制领域、条文规制任务划分以及例外条款等方面突破了SCM所确立的传统反补贴规则。以规则自洽性和公平对等、程序正义、成本效益这三大基本理念为评判标准,可以较为客观地评价CPTPP的规则更新。事实证明,CPTPP反补贴规则的更新在推动新兴领域反补贴规则形成与先试之同时,亦存在词义不明、规制领域错漏和例外规则缺位等潜在缺陷。在申请加入CPTPP的过程中,我国应针对上述缺陷的弥补问题充分思考及研究,从条约谈判和条约解释的双重路径出发,重点避免规制对象范围的扩大,促进将国内产业列为不利影响的作用对象,并推动健全不利影响规则的规制领域,以更加积极主动的姿态争取国际反补贴规则朝着有利于自身利益的方向变革发展。The adverse effects and injury rules of CPTPP's non-commercial assistance provisions break through the traditional countervailing rules established by SCM in terms of the regulatory object,the regulatory field,the division of the regulatory tasks of the rules,and the exception clause.Taking the self-consistency of the rules and the three basic concepts of fairness and reciprocity,procedural justice and cost-effectiveness as the judgment criteria,the CPTPP rule update can be evaluated more objectively.It has been proved that,while the update of CPTPP countervailing rules promotes the formation and practice of countervailing rules in emerging areas,there are also potential defects such as unclear terminology,omission of regulatory areas and absence of exception rules.In the process of applying to join CPTPP,China should fully consider and study the issue of making up for the above deficiencies,starting from the dual path of treaty negotiation and treaty interpretation,focusing on avoiding the expansion of the scope of the target of regulation,promote the domestic industry as the target of adverse effects,and promote the sound regulatory field of adverse effects rules,to strive for the change and development of international countervailing rules in the direction favourable to China's interests more proactively.
