摘 要:在变革国际投资法以应对气候变化方面,既有努力侧重于更新双边投资条约,不太重视国际组织的作用和潜力。近年来,OECD把投资条约如何应对气候变化问题确立为一项重要造法计划,这是其在20世纪90年代发起《多边投资协定》谈判后再次在国际投资法方面开展的重大造法行动。由于OECD的影响力,无论其造法努力最终表现为多边条约抑或条约范本、政策指南等,都可能对其他国家的国际投资法实践产生重要影响。In the context of reforming international investment law to address climate change issues,previous efforts have focused on updating bilateral investment treaties(BITs).However,the role and potential of international organizations has been largely neglected.In recent years,the OECD regards how investment treaties can respond to climate change issues as an important law-making project.It is a major international law-making activity after the OECD initiated the negotiation of the Multilateral Agreement on Investment(MAI)in the 1990s.Because of OECD's influence,whether the OECD ultimately produces multilateral treaties,model treaties,policy guidelines,etc.,the law-making activities are likely to have a significant impact on the practice of international investment law in other countries.
