摘　　要：数字化时代金融稳定风险面临着“数据鸿沟”,复杂金融市场与关联网络、数字金融创新的“破坏性”以及对金融危机事件中缺乏监管数据的反思显示出,金融稳定风险是金融数据收集短缺和无效利用引发的风险。“数据鸿沟”引发了金融监管内外部三个场景的权力失衡困境,是现有滞后、静态且单维的信息规制路径所致,有必要正确认识数据在政府治理和金融监管中的定位和功能,探索金融稳定风险防范的数据治理路径。从国际金融治理与美欧金融市场的监管实践来看,金融稳定数据治理以协同流通为原则,具备要素充足与互通共享的双层架构。应在金融法制定的契机下重构金融稳定风险防范与金融风险早期纠正制度体系,推动金融监管从信息规制走向数据治理路径,在权力失衡的三个场景中分别完善金融法治的约束、促进和协调。In the digital era,financial stability risks face a“data divide”.The complexity of financial markets and their interconnected networks,the disruptive nature of digital financial innovations,and reflections on the lack of regulatory data during financial crises reveal that financial stability risks arise from insufficient financial data collection and ineffective utilization.This“data divide”has led to power imbalances in three scenarios within and beyond financial regulation,stemming from existing lagging,static,and one-dimensional information regulatory frameworks.It is imperative to accurately recognize the role and function of data in government governance and financial regulation and to explore a data governance pathway for preventing financial stability risks.Drawing from international financial governance and regulatory practices in U.S.and European markets,financial stability data governance adheres to the principle of collaborative circulation,featuring a dual-layered structure of sufficient data elements and interoperable sharing.Seizing the opportunity of financial law enactment,the institutional framework for financial stability risk prevention and early correction of financial risks should be restructured.This entails shifting financial regulation from an information-based approach to a data governance pathway,refining legal constraints,incentives,and coordination in the three scenarios of power imbalance.
