区际刑事司法协助的问题与进路--基于粤港澳大湾区基层检察实践的分析

摘　　要：有别于民商事领域,内地与港澳地区在刑事司法协助上进展缓慢,实践中合作意愿偏低、协助范围狭窄、跨境调证困难等问题长期存在。地方合作的延拓有赖于顶层设计层面的先行授权。当前构建统一制度安排并不现实,宜采取“四阶段”式分步探索,由各法域刑事司法协助参与方的最高级别机关共同签订框架安排,在达成合作指导原则共识基础上,以粤港澳大湾区为先行样本,围绕实践难题开展试点探索。在积累充足试点经验后,以示范法形式制定统一的区际刑事司法协助规则,并最终经各自立法程序转化为本法域内法律规范。在大湾区试点探索领域方面,可考虑从跨境取证规则统一、犯罪情报信息共享、刑事诉讼移管、非羁押强制措施及社区矫正执行协作、刑事裁判互认等制度机制建设上展开。Different from the civil and commercial fields,the mainland and Hong Kong and Macao have made slow progress in criminal judicial assistance,and problems such as low willingness to cooperate in practice,narrow scope of assistance,and difficulties in cross⁃border investigation have long existed.The extension of local cooperation depends on the prior authorization at the top⁃level design.At present,it is not realistic to construct a unified legal system,so it is advisable to explore it step by step in“four stages”.Firstly,framework arrangements should be signed jointly by the highest⁃level authorities of the parties involved in criminal legal assistance in each jurisdiction.On the basis of reaching a consensus on the guiding principles of cooperation,the Guangdong⁃Hong Kong⁃Macao Greater Bay Area should be taken as an early example to carry out pilot exploration on practical problems.After the accumulation of sufficient pilot experience,it is possible to consider the formulation of unified inter⁃regional criminal judicial assistance rules in the form of model laws,and ultimately through the respective legislative procedures of each legal region,into the legal norms in their own jurisdictions.In terms of areas that should be explored on a pilot basis in the Guangdong⁃Hong Kong⁃Macao Greater Bay Area,consideration may be given to exploring institutional mechanisms such as the unification of cross⁃border evidence collection rules,the sharing of criminal intelligence information,the transfer of criminal proceedings,cooperation in the implementation of non⁃custodial compulsory measures and community corrections,and the mutual recognition of criminal adjudication.
