构建共同富裕视角下平台公司社会责任监督机制

摘　　要：共同富裕是社会成员相互帮助、共享社会成果、满足社会成员的精神与物质需求。换言之,公司作为社会成员之一,在其能力所及范围,对社会成员有一定的责任,此即公司社会责任。而平台公司,具备一定的公共职能,更应追求公共利益,服务社会成员,履行社会责任。虽然新《公司法》第20条进一步明确公司社会责任的内涵,但仍没有规定相应的监督措施,无法改变公司社会责任只是一个宣示性条款。据此,本文通过建构公司社会责任的监督机制,促使平台公司履行社会责任,从而实现共同富裕的目标。Common prosperity refers to the mutual help,sharing social achievements,and meeting the spiritual and material needs among members of society.In other words,as one of the members of society,companies have certain responsibilities to the members of society within its capabilities,and this responsibility is corporate social responsibility.Platform companies,which have certain public functions,should pursue public interests,serve members of society,and fulfill social responsibilities.Although Article 20 of the New Company Law clarifies the connotation of corporate social responsibility,it still does not provide corresponding supervision measures.The inability to change corporate social responsibility is only a declaratory clause.Accordingly,this paper constructs a supervision mechanism for corporate social responsibility to promote platform companies to fulfill their social responsibilities,so as to achieve the goal of common prosperity.
