摘 要:以行政执法权横向集中为导向的县级综合行政执法改革带来了监管部门和执法部门的跨部门协作难题,既有研究侧重从体制机制角度进行一般化分析,较少从部门间权责关系的视角进行深入解读。A区综合行政执法改革的实践表明,查处分离的流程再造打破部门分割的同时也造成部门间权责关系配置的失衡,这是跨部门协作困境的根源。具体而言,查处分离打破部门自立性,带来部门事权的不完整和事责的不清晰,其中部门间权力的支配性弱化、依附性增强,部门间责任的连带性、部门避责性和责任压力失衡不断加剧。部门间权责的依附性对跨部门协作提出常态化要求,但其权责模糊与失衡并不利于跨部门的高效协作,跨部门协作面临协作成本高、协作难度大、协作动力不统一等困境。基于此,要厘清跨部门之间的权责边界,保持部门自立性的同时,实现跨部门协作的积极性。The reform of comprehensive administrative law enforcement at the county oriented by the horizontal concentration of administrative law enforcement power has brought about the problem of inter-departmental collaboration between regulatory departments and law enforcement departments,and the existing studies focus on general analysis from the perspective of institutional mechanisms,but lack of in-depth interpretation of this problem from the perspective of inter-departmental authority and responsibility relationship.The practice of comprehensive administrative law enforcement reform in district A shows that the process reengineering of investigation and punishment separation breaks the division of departments,and also causes an imbalance in the allocation of authority and responsibility between departments,which is the root cause of the dilemma of inter-departmental collaboration.Specifically,the separation of investigation and punishment breaks the independence of departments,brings about the incompleteness of departmental authorities and the unclarity of responsibilities,in which the dominance of inter-departmental authority is weakened,the dependence is enhanced,and the joint and several responsibilities of inter-departments,the imbalance of departmental responsibility avoidance and responsibility pressure are constantly intensifying.The dependence of inter-departmental authority and responsibility puts forward the normalization requirements for inter-departmental collaboration,but the ambiguity and imbalance of authority and responsibility is not conducive to efficient inter-departmental collaboration,and inter-departmental collaboration faces the difficulties of high cost,difficulty and inconsistent motivation.Based on this,it is necessary to clarify the boundaries of authority and responsibility between departments,maintain the independence of departments,and realize the enthusiasm of inter-departmental collaboration.
