摘 要:社区物业冲突作为一种复杂性的城市社区冲突,是现代城市基层社会治理中的热点、难点与痛点所在。本文采用多理论分析视角,通过对物业服务企业与房地产开发商、业主群体和基层政府间“三重利益关系”的多案例分析,探究其与开发商之间委托代理关系下的“市场失灵”问题、业主及业委会之间集体行动困境理论下的“社会失灵”问题,以及基层政府之间利益相关者理论下的“政府失灵”问题,并基于共生理论视域提出一种整体性解决方案,即探索发展由党建引领的社区物业管理委员会等多元社区行动共生联合体,厘清政府职责权限和规范发展社区物业服务企业,明确物业公司与开发商间的权责界限,规范委托代理与公共服务合同购买关系,积极培育业主与物业公司间的制度信任,创建有效的制度性约束等。At present,there are multiple failures among market,government and society in the field of community property service supply at grass-roots level in China,which leads to frequent conflicts in property disputes for a long time.As the complex urban community conflict,community property conflict is the hot,difficult,pain and focal point in modern urban grass-roots social governance.From the perspective of multi-case analysis,this article analyzes the “triple interest relationship” between property service enterprises and real estate developers,owners' groups and grass-roots governments,aiming at exploring the problems of “market failure” under the principal-agent relationship between property service enterprises and developers,“social failure” under the collective action dilemma theory with owners and industry committees,and “government failure” under the stakeholder theory with grass-roots governments,and on these basis,puts forward the holistic solution based on symbiosis theory.Firstly,to explore the development of community property management committees led by the party and government,and other multi-community action symbiosis consortia;Secondly,to standardize the relationship between principal-agent and public service contract purchase,and define the power and responsibility boundary between property companies and developers;Thirdly,to cultivate actively institutional trust between owners and property companies and create effective institutional constraints;Fourthly,to clarify government responsibilities and authority through “two-pronged approach” and standardize community property service enterprises.
