数字经济犯罪的系统考察与刑法应对

摘　　要：数字经济犯罪是由涵盖信息数据、数字技术和信息网络三个领域的犯罪形态共同构成的犯罪体系。传统法益保护模式无法适应数据法益的整合性,传统行为规制模式无法涵盖数字犯罪行为外延,数字经济犯罪已对刑法形成系统挑战。我国刑法通过预防性刑法立法及能动性刑事司法对数字经济犯罪作出回应,但仍存在诸多问题。因此,溯源数据经济的基础性结构,对数字经济犯罪应进行系统性考察,而不应割裂三个领域犯罪的整体性,刑法亦应予以体系化应对,而不应局限于某特定领域的犯罪治理,应当确立“刑法修正案+附属刑法”的立法模式,以刑法修正案调整数字经济犯罪罪名体系,以附属刑法立法模式完善数字经济犯罪构成要件。The criminal activities associated with the digital economy constitute a criminal system formed by the convergence of three areas:information data,digital technology,and information networks.The traditional legal protection model is unable to adapt to the integrative nature of data interests,and the conventional behavioral regulation model fails to encompass the extension of digital criminal behaviors.Digital economy crimes have posed a systematic challenge to criminal law.In response,our country's criminal law has addressed digital economy crimes through preventive legislative measures and proactive criminal justice,yet numerous issues remain.Therefore,it is essential to conduct a systematic examination of the foundational structure of the data economy concerning digital economy crimes,rather than isolating the wholeness of crimes across the three fields.Criminal law should also provide a systemic response,rather than being limited to the governance of crimes in a specific area.A legislative model should be established that involves “amendments to criminal law and supplementary criminal law” to adjust the offense system for digital economy crimes through amendments to the criminal law and to enhance the constitutive elements of digital economy crimes through the supplementary criminal law legislative model.
