摘　　要：战略性矿产资源的含义与范畴具有开放性与动态性,法学视角下的战略性矿产资源安全治理强调安全价值的优先级与制度供给的能动性。战略性矿产资源安全治理应当坚持发展与安全统筹兼顾、国际与国内共同推进、供给侧与需求侧协同发力的应然逻辑。当前战略性矿产资源安全治理的紧迫性与制度规范的不完善,亟须以系统的法律体系为依托、以完备的制度规范为准绳,从宏观、中观、微观三个维度,搭建以《宪法》与《国家安全法》定基调、以《矿产资源法》(2024修订)指方向、以“战略性矿产资源具体管理办法”抓重点的法律体系;从前端、中端、末端整个周期构建覆盖战略性矿产资源安全治理全过程的目录清单与专项规划并重、勘查开采与资源储备齐抓、循环利用与出口管制共管的制度规范。The definition and scope of strategic mineral resources are inherently open-ended and dynamic.From a legal perspective,the governance of strategic mineral resource security emphasizes the primacy of security values and the proactive nature of institutional supply.Effective governance should adhere to the following normative logic:balancing development and security,coordinating domestic and international efforts,and aligning supply-side and demand-side measures.Given the urgency of strategic mineral resource security governance and the current inadequacies in regulatory frameworks,it is imperative to establish a comprehensive legal system supported by robust institutional norms.This involves a three-dimensional approach:Macro-level:establishing foundational principles through the Constitution and the National Security Law;Mid-level:providing directional guidance via the revised Mineral Resources Law(2024);Micro-level:implementing focused management through specific Administrative Measures for Strategic Mineral Resources.The regulatory framework should span the entire governance lifecycle:(1) Front-end:parallel development of catalog lists and specialized plans;(2) Mid-end:integrated management of exploration,extraction,and resource reserves;(3) Back-end:coordinated oversight of recycling and export controls.
