吸纳型合作监管:平台场域中的政企合作监管机制——基于S市网络交易监管的观察

摘　　要：传统场域中政企合作监管通常处于边缘地位,但在平台场域中却成为主要形式。现有文献将政企合作监管机制归纳为配合型、谋利型和开放型,但难以完全解释在平台场域的多元监管结构中政府和平台企业合作监管的形成。本文基于对S市网络交易监管部门与平台企业的互动观察,提炼出吸纳型合作监管的形成逻辑和机制解释。研究发现,在平台海量数据、交易跨域、违规隐蔽的情境驱动下,政府受监管资源限制,尝试将平台企业的监管能力吸纳进入监管体系,以弥补政府监管“空缺”。但是,政府与平台企业的合作监管难以照搬传统模式。政府在平衡监管独立性与可行性之间,采取了吸纳型合作监管的行动策略,通过意识吸纳、规则吸纳和激励吸纳等推动政企合作监管。吸纳型合作监管的提出,阐明了平台这一全新场域中的政企合作监管机制,丰富了合作监管理论,对提升平台治理成效具有一定政策参考价值。In traditional fields, government-enterprise cooperative regulation often occupies a marginal role.However, in the platform fields, it becomes a predominant form. Existing literature categorizes government-enterprise cooperative regulation into three types: Passive cooperation, profit-driven, and win-win. These types,however, are insufficient to fully explain the formation of cooperative regulation between government and platform enterprise within the multiple regulatory structure of the platform field. By analyzing the interaction practices between the online transaction regulatory department and platform enterprises in S City, this article proposes absorptive cooperative regulation as the explanation and elaborates the formation logic and mechanism.The study finds that, driven by the massive data on platforms, cross-border transactions, and covert violations,and constrained by the limited regulatory resources, the government attempts to absorb the regulatory capacity of platform enterprise into its regulatory system to fill the "gaps" in regulation. However, collaborative regula-tion between government and platform enterprise can't simply replicate traditional models. In balancing regulatory independence with feasibility, the government adopts an absorptive cooperative regulation strategy, which includes awareness absorption, rule absorption, and incentive absorption. These strategies promote governmententerprise cooperative regulation. The introduction of absorptive cooperative regulation clarifies the cooperative regulation mechanism between government and platform enterprise in this new platform domain, enriches the theory of government-enterprise cooperative regulation, and offers policy reference value for enhancing platform governance effectiveness.
