低龄未成年人核准追诉程序的司法适用

摘　　要：《中华人民共和国刑法》第17条第3款规定的低龄未成年人核准追诉程序,在实践运行中面临着适用条件审查形式化、审批流程不当简化、证明标准差别化等问题的困扰。这些问题的出现主要源于对其适用规则的不当解读,需要通过明确其应然适用规则方式予以防范。在低龄未成年人核准追诉程序适用中,应当坚持适用条件的形式与实质审查并重,遵循案件一律层报至最高人民检察院的审批流程,并以同一证明标准认定核准追诉事实。为此,需要在此类案件中强化低龄未成年人的社会调查工作,恪守最高人民检察院对核准追诉程序的终结权,并以证据确实、充分标准统领案件事实证明。The approval and prosecution procedure for young minors stipulated in Article 17,Paragraph 3 of the Criminal Law in China is faced with difficulties in practical operation,such as the formalization of application conditions review,improper simplification of approval processes,and differentiation of proof standards.And these problems mainly stem from improper interpretation of their applicable rules,which need to be prevented by clarifying the way they should be applied/how the rules should be applied.In the application of the approval and prosecution procedure for young minors,both formal and substantive examination of the applicable conditions should be emphasized,and the approval process of reporting cases to the Supreme People's Procuratorate should be followed uniformly,and the approved prosecution facts should be determined with the same proof standard.To this end,it is necessary to strengthen the social investigation of young minors in such cases,abide by the Supreme People's Procuratorate's power to terminate the approval of prosecution procedures,and lead the factual proof of the case with accurate evidence and sufficient standards.
