摘　　要：BBNJ协定第42条规定了能力建设和海洋技术转让的模式,但有关模式的规定较为笼统,具体实施机制尚不完备,可操作性不强。因此,BBNJ协定下能力建设和海洋技术转让模式的实施需要借鉴现有经验,特别是考虑国际海底管理局、联合国海洋事务和海洋法司以及政府间海洋学委员会等机构的现有经验,同时结合BBNJ协定的一般原则和宗旨,确定模式实施的价值遵循,如公平和公正分享惠益、利益攸关方充分参与以及兼顾国情多样性等。并且,在未来能力建设和海洋技术转让模式实施过程中,应当制定并落实能力建设和海洋技术转让的发展战略和行动计划,在全面推动其参与型进程的基础上健全并优化能力建设和海洋技术转让的管理机制。Article 42 of the BBNJ Agreement stipulates modality for capacity-building and the transfer of marine technology.However,from the perspective of regulations,the relevant modality regulations are relatively general,the specific implementation mechanism is not yet complete,and the operability is not strong.Therefore,the implementation of capacity-building and the transfer of marine technology modality under the BBNJ Agreement needs to be informed by existing experience,in particular by taking into account the existing experience of the International Seabed Authority,Division for Ocean Affairs and the Law of the Sea and the Intergovernmental Oceanographic Commission,among others.At the same time,taking into account the general principles and purposes of the BBNJ Agreement,it should be determined that the value of the implementation of the modality follows,such as fair and equitable sharing of benefits,full participation of stakeholders and taking into account the diversity of national conditions.And,in the implementation of future modality for capacity-building and the transfer of marine technology,development strategies and action plans for capacity-building and the transfer of marine technology should be developed and implemented,and management mechanisms for capacity-building and the transfer of marine technology should be improved and optimized on the basis of a comprehensive promotion of their participatory processes.
