摘 要:党内法规与党的规范性文件的关系辨析是党内法规研究的核心议题,学界多有讨论。之所以旧题新论,一是因为2019年《中国共产党党内法规制定条例》等文件修订后,党内法规和党的规范性文件的内涵外延发生变化,过往有些观点已不适用;二是因为有关两者关系的不少论点存在学术交锋,有必要梳理反思并准确归纳判断。分析两者的关系,需要定位于党建话语体系中,着眼于全面从严治党的战略布局,两者的制度属性统一于制度治党、依规治党、党的制度建设、党内法规制度体系建设、党的自我革命制度规范体系这五个管党治党具体布局中,而这也是两种制度形态具有高度相似性的根本原因。两者的规范差异,体现在制定主体、调整事项、制定程序、规范效力、形式要件等方面,且应当辨析其中的相关学理争议。The relationship between intra-Party rules and regulations and the Party’s normative documents is a core topic in the study of intra-Party rules and regulations,which has been widely discussed in academic circles.The reasons for discussing this issue are:Firstly,the revision of documents such as the“Regulations on the Formulation of Intra-Party Rules and Regulations of the Communist Party of China”in 2019 has led to changes in the connotations and extensions of intra-Party regulations and the Party’s normative documents,making some previous viewpoints no longer applicable.Secondly,there are many academic debates about the relationship between the two,and it is necessary to sort out,reflect on,and accurately summarize and judge them.To analyze their relationship,it is necessary to position it within the framework of the Party building dis‐course system and focus on the strategic layout of exercising full and rigorous Party self-governance.The insti‐tutional attributes of the two are unified in the five specific layouts of governing the Party by systems,govern‐ing the Party according to regulations,the construction of the Party’s systems,the construction of the intra-Party regulations system,and the system norms for the Party’s self-revolution.This is also the fundamental rea‐son why these two institutional forms share a high degree of similarity.The normative differences between the two are reflected in aspects such as the formulating subjects,regulated matters,formulating procedures,norma‐tive effectiveness and formal requirements.And the relevant theoretical controversies should be analyzed.
