跨境数字贸易网络威胁的韧性规制体系建构:以防范系统性风险为视角

摘　　要：跨境数字贸易在推动经济增长的同时,因其结构复杂性和数据流动特性,可能面临网络威胁风险。而数字贸易系统的互联性使得任何局部故障都可能引发连锁反应,最终演化为导致整体系统崩溃的系统性风险。系统性风险可能由技术漏洞、基础设施脆弱、恶意入侵等问题引发,也可能由数据泄露、数据滥用、数据操控等数据安全问题而导致;具体表现为网络威胁下的支付安全、数据保护、交易流程完整性受损,进而影响交易安全,最终破坏市场信心。面对系统性风险,刚性规制存在滞后性也缺乏灵活性,而韧性规制强调风险预防、抵御、适应、修复和自我学习及发展功能。刚性规制向韧性规制的转变,体现了治理主体角色的变化。在韧性规制思路下,应建立风险管理机制和应急响应体系,完善网络基础设施建设的法律及相关政策指引,优化数字贸易营商环境以保护交易安全;鼓励网络安全企业融入国家战略布局,形成政企联动机制;加强与国际经济体的网络安全合作;依托数字信用体系提升市场信任度。While promoting economic growth, cross-border digital trade may face systemic risks due to its structural complexity and data flow characteristics.The interconnected nature of the digital trade system means that any local malfunction can trigger a chain reaction, ultimately evolving into systemic risks that cause the overall system to collapse.These systemic risks can be caused by technical vulnerabilities, infrastructure weaknesses, malicious intrusions, and other technical issues, as well as data breaches, data abuse, data manipulation, and other data security issues.Specifically, these risks manifest as compromised payment security, data protection, and transaction process integrity under cybersecurity threats, which in turn affect transaction security and ultimately undermine market confidence.In response to systemic risks, rigid regulation inherently suffer from implementation latency and structural inflexibility, while resilient regulation emphasizes risk prevention, resistance, adaptation, recovery, self-learning, and development functions.The shift from rigid regulation to resilient regulation reflects changes in the role of governance entities.Under the resilient regulation approach, it is necessary to establish risk management mechanisms and emergency response systems, strengthen legal frameworks and policy guidelines for cybersecurity infrastructure development;enhance the digital trade ecosystem to safeguard transactional integrity, facilitate cybersecurity enterprises to participate in national strategic planning, and establish public-private collaboration frameworks;strengthen cybersecurity cooperation with global economic entities;and leverage digital trust infrastructure to elevate market credibility.
