摘　　要：新技术发展加剧了规制不确定性。在日益增长的规制挑战中,试验性规制以其动态适应性优势,正逐渐成为应对新兴技术领域规制难题的前瞻性方案。这种探索性的规制范式延续了我国长期秉持的“先行先试”的工作理念和方法,又在新技术领域的规制实践中呈现出更具创新性的实践样态,从试验性立法到监管沙盒运用,其制度样态的多样性与适应性不断拓展。作为兼具学习与调适功能的规制策略,其制度效能的实现高度依赖程序机制的科学性。在未来,需要增强试验性规制全过程的程序约束,确保试验性规制启动程序的规范性,实施过程的透明度以及试验性规制效果的评估与转化,形成“规范启动—透明实施—科学评估—有效转化”的良性运行闭环,推动试验性规制的良性运转,进而提升试验性规制的制度效能。The rapid development of new technologies has significantly intensified regulatory uncertainty.Amid growing governance challenges,experimental regulation,with its dynamic adaptability,is emerging as a forward-looking solution to addressing regulatory dilemmas in emerging technological fields.This exploratory regulatory paradigm not only extends China's long-held“trial and exploration”approach but has also demonstrated increasingly innovative practices in new technology governance,i.e.from experimental legislation to regulatory sandbox applications,which continually expands the diversity and adaptability of its institutional forms.As a regulatory strategy that combines learning and adaptive functions,the realization of its institutional effectiveness critically depends on the scientific design of procedural mechanisms.In the future,it is essential to strengthen procedural constraints throughout the entire experimental regulatory process,ensuring the standardization of initiation procedures,transparency in implementation,and robust evaluation and translation of regulatory outcomes.This will establish a virtuous cycle of“standardized initiation-transparent implementation-scientific evaluation-effective translation”,thus promoting a sound operation of experimental regulation and enhancing its institutional efficacy.
