中国式现代化视域下基层治理清单制实践的法治逻辑

摘　　要：新时代基层治理清单制的多样探索和丰富实践是中国式现代化与时推进并不断深化的生动体现。条目化是世界既往各法系在其发展进程中共同凝结的规范创制经验,清单制则是以往成文立法条目化法理演进的新形态,其在适用条件、行为模式及评价后果等多方面对现行法律规范结构加以投射和反映,而基层治理清单作为国家治理在基层的再统合,带有将“法”的规范形式与“治”的实践内容相链接的鲜明属性。当前基层治理清单制面临着疏漏与失调的双重叠加、形式与情境的深层割裂、条法与块治的结构矛盾等深层次问题。基于中国式现代化的演进取向和时代要求,需并行推进国家法律规范的调适与基层治理清单的赋权,明定基层自治规范的法律规范属性,开展以公众需求为导向的基层治权设计,增加基层治理清单中的多重情境要素,开通多元主体实时参与的端口,强化基层动态治理的技术保障,达成以清单制为制度载体的基层“法”与“治”的有机融合。The diversified exploration and rich practice of the basic level list system in the new era is the vivid embodiment and latest achievement of Chinese modernization and continuous deepening.The list system is a new form of the evolution of the legal theory of the previous written legislation,which projects and reflects the normative structure of the current law in the aspects of application conditions,behavior patterns and evaluation consequences.As a re-integration of national governance at the grassroots level,the list of grass-roots governance has the distinct attribute of linking the normative form of“law”with the practical content of“governance”.At present,the basic management list system is faced with such deep-rooted problems as the double superposition of omissions and disorders,the deep separation of form and situation,and the structural contradiction between strip method and block rule.In line with the evolution orientation of Chinese-style modernization and the requirements of The Times,we should simultaneously promote the debugging of national legal norms and the empowerment of grassroots lists,clarify the legal normative attributes of grassroots autonomy norms,and carry out the design of grassroots governance oriented by public demand.At the same time,we should add multiple situ-ational elements in grassroots lists,open the port for realtime participation of multiple subjects,and strengthen the technical support for dynamic grassroots governance.To achieve the organic integration and deep integration of“law”and“governance”at the basic level with the list system as the institutional carrier.
