习近平法治思想视域下中华优秀传统法律文化的构成与传承

摘　　要：坚持和发展中国特色社会主义法治理论,要注重从中华优秀传统法律文化中汲取滋养。习近平法治思想清晰指明了中华优秀传统法律文化的关键构成内容,包括完备的成文法典、经典的法律著述、优秀的法治思想。习近平法治思想深刻阐明了中华优秀传统法律文化的运用方式和现实用途,即坚持“创造性转化、创新性发展”的基本原则,广泛应用于阐释法治基本原理和解答现实法治难题。习近平法治思想系统规划了中华优秀传统法律文化的传承路径,即在保护和整理法律文化历史遗迹、典籍和文物的基础上,加强对中华优秀传统法律文化的挖掘和阐发,推动其深度融入法学学科体系。Adhering to and developing the theory of socialist rule of law with Chinese characteristics,we should pay attention to drawing nourishment from the excellent traditional Chinese legal culture.Xi Jinping's thought of rule of law clearly points out the key components of Chinese excellent traditional legal culture,including complete written code,classic legal writings and excellent thought of rule of law.Xi Jinping's thought of rule of law profoundly clarifies the application and practical use of Chinese excellent traditional legal culture,that is,adhering to the basic principles of"creative transformation and innovative development",which is widely used to explain the basic principles of rule of law and solve practical problems of rule of law.Xi Jinping's thought of rule of law systematically planned the inheritance path of Chinese excellent traditional legal culture,that is,on the basis of protecting and sorting out the historical relics,classics and cultural relics of legal culture,we should strengthen the excavation and elucidation of Chinese excellent traditional legal culture,and promote its deep integration into the legal discipline system.
