技术的权力化和权力的技术化

摘　　要：伴随人工智能技术的日渐成熟及其在国家治理中应用场景的不断拓展和应用程度的不断加深,国家治理的数字化转型进程随之开启,数据和算法在国家治理中的影响力和控制力不断增强,数据技术和算法技术的权力特性日渐凸显,技术权力化的问题随之出现。与此同时,伴随数字技术在国家治理中嵌入程度的加深,智能立法、自动化行政和智能司法等正逐步成为现实,权力的技术化问题也由此产生。技术的权力化在给国家治理体系的完善和国家治理格局的平衡提供难得机遇的同时,也给资本介入国家治理提供了空间,国家治理面临失序的风险。面对技术的权力化趋势,政府在应用好技术权力的同时也要做好技术权力的规制工作。面对权力的技术化问题,政府在利用智能技术来提升国家治理效能的同时也要防范技术治理思维至上问题的出现,做好权力技术化背景下行政责任认定与责任追究工作,以确保行政权力的规范有序运行和责任政府建设水平不断提升。With the increasing maturity of artificial intelligence technology and its expanding in national governance,the digital transformation of national governance has begun.The influence and control of data and algorithms in national governance are growing,highlighting the power attributes of these technologies and leading to the issue of the empowerment of technology.Meanwhile,as digital technologies become more embedded in governance,intelligent legislation,automated administration,and AI-powered judiciary are emerging,resulting in the technicization of power.While the empowerment of technology provides a rare opportunity for the national governance system and balancing the national governance structure,it also offers space for capital to intervene in national governance,posing a risk of disorder in national governance In response to the trend of the empowerment of technology,the government needs to both utilize technological power and regulate it.Facing the issue of the technologization of power,the government should enhance the efficiency of national governance by using intelligent technology while guarding against the overemphasis on technological governance thinking,ensuring the orderly operation of administrative,and continuously improving the level of responsibility in government construction.
