纪检监察工作中予以了结制度的适用困境与优化路径

摘　　要：予以了结制度是纪检监察工作中的处置方式与适用程序之一。鉴于适用阶段、线索内容与后续处置的不同,在予以了结内部实际上存在不同的了结类型。问题线索质量的差异化显著、制度规范供给不足、监督制约机制缺失构成了予以了结制度目前存在的主要适用问题。为了确保予以了结制度的规范化运作、提升纪检监察机关的监督效能,应从以下三个方面对予以了结制度进行优化:首先,在“事前”构建科学化与高效化的线索处置机制;其次,通过明确了结标准与了结要求、厘定予以了结处置决定的作出主体等方式完善予以了结制度的基本程序框架;最后,合理构建相应的配套制度以确保予以了结的质效实现。The settlement system is one of the disposal methods and procedural approaches in disciplinary inspection and supervision work.Due to varying stages of application,types of clues,and subsequent handling,there are different categories of settlements within the system.The significant variations in the quality of problem clues,insufficient institutional norms,and the lack of an effective supervision and restraint mechanism are the primary challenges in the current application of the settlement system.To ensure the standardized operation of the settlement system and improve the supervisory efficiency of disciplinary inspection and supervision bodies,the system should be optimized in three key areas:First,a scientific and efficient clue disposal mechanism should be established in advance.Second,the basic procedural framework of the settlement system should be enhanced by clarifying settlement standards and requirements,as well as determining the decision-making authority for settlements.Finally,a well-designed supporting system should be put in place to ensure the achievement of both quality and efficiency.
