农村自治组织代行集体经济组织职能问题研究——基于自治组织“社经合一”属性的思考

摘　　要：我国农村集体经济组织法第64条对农村自治组织代行集体经济组织职能问题作出了专门规定。该条规定的解释适用应基于自治组织“社经合一”的基本定性,将代行行为视为自治组织以另一种身份——集体经济组织身份——行使职能的行为。自治组织是依法唯一能够代行集体经济组织职能的组织,对是否代行集体经济组织职能并没有选择的自由。在未设立集体经济组织的情况下,该法规定的集体经济组织的所有职能都应由自治组织行使;集体财产和成员权益事项应当结合农村集体经济组织的职能进行界定;自治组织讨论、决定集体财产和成员权益事项应当根据实体与程序区分原则确立应参照该法规定的具体内容。Article 64 of the Law on Rural Collective Economic Organizations establishes a unique functional substitution mechanism whereby rural autonomous organizations assume the operational responsibilities of collective economic organizations.Through an interpretative analysis grounded in the socio-economic integration theorya defining characteristic of autonomous organizations under Chinese rural governance framework,this study reconceptualize such functional substitution as the dual institutional identity of autonomous organizations.Specifically,their assumption of collective economic functions constitutes an expansion of their statutory obligations rather than discretionary authority.They are revealed to function mainly in the following three respects:First,they serve as the exclusive legal entities mandated to fulfill collective economic functions in the absence of specialized economic organizations.Second,the delineation of collective property rights and membership entitlements must align with the functional parameters prescribed for rural collective economic organizations;Third,substantive-procedural bifurcation principles should guide autonomous organizations in adjudicating matters involving collective property and member rights.
