摘　　要：将政策中的数据产权理解为由数据持有、数据使用和数据经营等多个权能所构成的单一产权体系的学说,不仅不符合“淡化所有权,强调使用权”理念下所形成的避免数据专有和垄断的要求,更难以应对“数据共生与数据独占冲突”“人身利益与财产利益并存”“产权排他与数据共享悖论”等数据产权建构难题。数据产权是一个集合性概念,其上应该并且可以进行权利分解,从而形成“权利分置”结构。这一结构是以数据处理者的数据持有权为核心,以数据来源者权和数据使用权为两翼,在数据生产和流通两大阶段渐次展开的数据产权“双阶二元结构”。这一结构的内在机理是数据来源者、数据处理者和数据使用者之间基于数据从生产到流通阶段“分散—聚合—分散”的形态变迁形成的“财产利益集散机制”。在此机制下,数据来源者权、数据持有权、数据使用权得以渐次形成和展开。数据处理者享有控制和利用数据,并排除他人干涉的数据持有权。数据来源者对由其贡献所生数据享有复制、访问和转移等公平使用权。数据使用者对经由流通取得的数据享有加工使用、对外经营以及获取收益等数据使用权。Prevailing theories conceptualizing data property rights as monolithic regimes combining possession,utilization,and governance powers prove inadequate in addressing the tripartite paradoxes of data governance:(i)symbiotic existence versus exclusivity claims,(ii)convergence of personal dignity and economic interests,and(ii)inherent tension between proprietary exclusion and sharing imperatives.This study proposes a paradigm shift from conventional unitary property frameworks to a disaggregated rights architecture.The proposed modular system manifests as a dual phase,two-dimensional structure operationalized across data's lifecycle.During the production phase,data source rights and processor rights emerge.The circulation phase activates usufructuary rights permitting access,operational utilization,and derivative value extraction.Crucially,processor stewardship serves as the structural nexus,mediating between source entitlements and downstream usage privileges.The system's dynamism stems from its value chain redistribution mechanism,mirroring data's morphological transitions from decentralized inputs to aggregated assets and finally redistributed commodities.Through this tripartite interaction framework,processors obtain exclusive control over curated datasets,sources retain equitable claims to value generated from their contributory data,and users acquire operational freedoms.
