摘 要:建设工程价款优先受偿权作为一种法定担保物权,本质在于通过保障承包人工程价款来保护建筑工人合法权益。近年来,我国建筑业发展态势趋缓,部分承包人受到债务危机、工程质量问题、政策调整等因素影响退出建设工程项目,由新承包人继续施工。续建工程价款优先受偿权的适用主体与范围、放弃与限制及续建工程未竣工、合同无效情形等相关问题值得探讨。为维护建筑工人合法权益,续建工程承包人需在风险控制和项目管理方面采取措施,确保项目顺利完成。The priority right to compensation for construction project costs,as a statutory security right,essentially aims to protect the legitimate rights and interests of construction workers by safeguarding the contractor's project costs.In recent years,the development trend of China's construction industry has slowed down,and some contractors have withdrawn from construction projects due to factors such as debt crisis,engineering quality problems,and policy adjustments,and have been replaced by new contractors to continue construction.The applicable subject and scope of the priority right to compensation for the continued construction project price,waiver and limitation,as well as the situation where the continued construction project is not completed and the contract is invalid,are worth exploring.In order to safeguard the legitimate rights and interests of construction workers,the contractor of the continued construction project needs to take measures in risk control and project management to ensure the smooth completion of the project.
