制度宪法学的实践功能初议

摘　　要：构建中国自主的宪法学知识体系,首先须健全宪法学的学科体系,而科学地设计宪法学的学科体系必须区分宪法学学科知识的特性,在此基础上,才能有效地构建理论宪法学、制度宪法学和实践宪法学三种宪法学知识形态有机统一的宪法学的学科知识体系。目前,制度宪法学尚未在中国宪法学界引起足够的关注,其所具有的实践功能更是长期被理论界所忽视。认真研究和反思制度宪法学构建的学术意义以及关注制度宪法学的实践功能,可以最大限度地提升中国宪法学理论研究水平,并为全面实施宪法、充分发挥宪法的根本法权威作用提供必要的法理支撑和实践方案。To construct an autonomous knowledge system of constitutional law in China,it is first necessary to establish and improve the disciplinary framework of constitutional law.The scientific design of this framework requires distinguishing the characteristics of constitutional knowledge,on the basis of which an integrated disciplinary system can be effectively built-one that unifies theoretical constitutional law,institutional constitutional law,and practical constitutional law.Currently,institutional constitutional law has not yet garnered sufficient attention within China’s constitutional academia,and its practical functions have long been overlooked by theoretical circles.A thorough study and reflection on the academic significance of constructing institutional constitutional law,along with an emphasis on its practical functions,can significantly elevate the theoretical research level of Chinese constitutional law.Furthermore,it can provide essential legal support and practical solutions for the comprehensive implementation of the constitution and the full realization of its fundamental legal authority.
