数字赋能跨境腐败治理的动因、逻辑与制度

摘　　要：跨境腐败数字化、公众生活网络化与数字反腐效能日益显现“三重”驱动,数字赋能跨境腐败治理确有现实需求与理论可能。依托大数据、人工智能、区块链等数字技术,对跨境腐败行为进行实时监测并建立跨境反腐网络平台进行信息共享,是实现数字赋能跨境腐败治理的逻辑起点与关键路径。为规避技术赋能治理的潜在风险,亟须嵌入区块链存证并明确法律效力,制定人工智能分析采信标准,构建跨境平台法律授权机制,以确保数据安全,从而实现数字工具法律赋权的制度创新;建立责任追究机制并实施全流程监督,制定技术伦理标准,以确保技术应用于执法的公正性,从而完成数字赋能跨境反腐执法保障的制度构建,推动跨境腐败治理从“被动响应”到“主动防御”的范式转换,助力我国腐败治理体系与治理能力的现代化。Driven by the“triple forces”of digitized cross-border corruption,increasingly networked public lives,and the growing efficacy of digital anti-corruption measures,digital empowerment presents both practical necessity and theoretical potential for cross-border corruption governance.Leveraging technologies such as big data,AI,and blockchain for real-time monitoring of corrupt activities,alongside establishing transnational anti-corruption platforms for information sharing,constitutes the logical foundation and critical pathway for digital-enabled governance.To mitigate risks,institutional innovations are imperative:embedding blockchain-based evidence preservation with legal validity,formulating AI analysis admissibility criteria,and creating legal authorization mechanisms for cross-border platforms to ensure data security.Concurrently,enforcement safeguards must integrate accountability mechanisms with full-process oversight and technical ethics standards to ensure fairness in technology deployment.These measures drive a paradigm shift from passive response to proactive defense in corruption governance,advancing the modernization of China’s corruption governance system and capabilities.
