金融法院“三审合一”审理机制的建构

摘　　要：根据现行立法与司法解释的规定,涉金融刑事案件并未纳入金融法院审理范围。考虑到金融案件存在大量民行刑交叉的情况以及发挥金融法院作为专门法院的专业性审判功能,我国应当在“严格依法、服务大局”等基本原则指导下,根据金融犯罪的理论划定涉金融刑事案件的范围,调整合议庭及审理程序的选择,辅之以技术调查官制度、专家辅助人制度等配套建设,在原有案件审理机制的基础上,完成金融法院“三审合一”审理机制的建构,以求实现金融法院对涉金融案件全方面、综合性的把握,提高金融案件审理的专业性与精准性。According to the provisions of the current legislative and judicial interpretation,criminal cases involving financial affairs are not included in the scope of financial courts.Considering the exis⁃tence of a large number of overlapping financial cases and the professional trial function of the financial court as a specialized court,Under the guidance of the basic principles of“strictly in accordance with the law and serving the overall situation”,To ating the scope of financial criminal cases according to the theory of financial crimes,Adjust the choice of collegial panel and trial procedures,With the technical in⁃vestigator system,the expert assistant system and other supporting construction,On the basis of the origi⁃nal case hearing mechanism,Complete the construction of the“three trials in one”trial mechanism of the fi⁃nancial courts,In order to realize the financial court’s comprehensive grasp of all aspects of financial cases,Improve the professionalism and precision of financial case trial.
