专家陪审制的功能定位、困境掣肘与程序优化

摘　　要：发展和完善专家陪审制不仅符合审判专业化的发展要求,更有利于实现陪审员的实质性参审,落实司法民主。专家陪审员在案件审理中的主要作用在于运用专业知识对案件涉及的专门问题进行分析判断,辅助法官解决案件审理中的技术问题和行业难题。然而司法实践中,专家陪审制却面临专家陪审员选任难、适用范围不合理、与其他技术事实查明机制衔接不畅的问题。对此,应考虑专家陪审制的特殊性,在选任方面,坚持多元化标准,通过组织推荐的方式分专业、分领域选任专家陪审员。在具体适用过程中,强化专家陪审制与其他技术事实查明机制的制约配合。在案件范围上,专家陪审制应适用于整体上具有专业性且该专业问题对裁判结果具有关键作用的案件中。The development and improvement of the expert jury system not only conforms to the development requirements of judicial specialization,but is also more conducive to achieving the substantive participation of jurors and implementing judicial democracy.The main role of expert jurors in case trials is to apply their expertise to analyze and judge the specialized issues involved in the case,assisting judges in resolving technical issues and industry-related difficulties in the trial process.However,in judicial practice,the expert jury system faces difficulties in selecting expert jurors,unreasonable scope of application,and poor coordination with other technical fact-finding mechanisms.In this regard,the particularity of the expert jury system should be taken into account.In the aspect of appointment,diversified standards should be adhered to,and expert jurors should be selected by means of organization recommendation,categorized by profession and field.During the specific application process,the coordination and restraint between the expert jury system and other technical fact-finding mechanisms should be strengthened.In terms of the scope of cases,the expert jury system should be applied to those cases that are professional as a whole and in which the professional issues play a crucial role in the adjudication outcome.
