新时代“枫桥经验”的法治化:基于软法治理路径

摘　　要：新时代“枫桥经验”的法治化已成为我国基层治理体系和治理能力现代化建设的重要命题。软法作为新时代“枫桥经验”天然的治理资源,在性质上属于公法契约,是新时代“枫桥经验”法治化的重要支点,在新旧时期的转换中,“枫桥经验”与软法的复调变迁反映了基层治理的现代化进程。软法内在的治理功能是其担当新时代“枫桥经验”法治化支点的关键,但软法同时面临着治理规范创制局限、治理基础机制不全和治理制度体系有阙三个层面的问题。为此,需要在新时代“枫桥经验”指引下,通过推动软法系统革新、夯实软法治理根基和构建软法治理体系的方式化解软法与治理之间的张力,从而实现基于软法治理路径的新时代“枫桥经验”法治化。The legalization,of the“Fengqiao experience”in the new era has become an important proposition in the modernization of China’s grass-roots governance system and governance capacity.Soft law,as a natural governance resource of the“Fengqiao experience”in the new era,falls into the category of the public law contract in nature and is an important fulcrum for the legalization of the“Fengqiao experience”in the new era.In the transition from the old era to the new era,the interaction between the“Fengqiao experience”and soft law reflects the modernization process of grass-roots governance.The inherent governance function of soft law is the key to its role as the fulcrum of the legalization of the“Fengqiao experience”in the new era,but soft law is also facing the limitations of creating governance norms,imperfect governance foundation mechanisms and deficiencies in the governance system at the three levels.To this end,under the guidance of the“Fengqiao Experience”in the new era,it is necessary to resolve the tension between soft law and governance by promoting the systematic innovation of soft law,consolidating the foundation of soft law governance and constructing a soft law governance system so as to realize the legalization of“Fengqiao Experience”in the new era based on the soft law governance path.
