轻罪司法的三重困境纾解与限缩路径构建

摘　　要：当前轻罪治理中的司法困境主要是由于实践中的重刑主义倾向导致,问题诘难的源头是轻罪刑事立法扩张的异化,构建司法上的限缩路径具有正当价值。应当在肯定刑事立法参与社会治理的合理性基础上,正确发挥司法纠偏功能,从定罪、量刑、犯罪附随后果三个维度应对立法扩张异化的风险。具体而言,应当明确定罪标准与出罪情节以实现对不当入罪的限制,在量刑过程中推动刑罚措施轻缓化、递进式地适用与执行,同时建立犯罪附随后果的分级分类处置机制,警惕轻罪司法的过度限缩。对实践中的重刑主义倾向进行正畸,纾解轻罪司法的三重困境,避免刑法丧失应有的惩罚功能,实现惩治犯罪与预防犯罪功能的和谐统一。The current judicial dilemma in the governance of misdemeanor crimes is mainly due to the tendency of doctrine of severe punishment in practice,and the source of the problem is the alienation of the expansion of criminal legislation on misdemeanor crimes,so that the construction of a judicial path of limitation and contraction has a justified value.On the basis of affirming the rationality of the participation of criminal legislation in social governance,the corrective function of the judiciary should be properly utilized to deal with the risk of the alienation of the expansion of legislation in the three dimensions of conviction,sentencing and the incidental consequences of crime.Specifically,conviction standards and incriminating circumstances should be clarified in order to limit inappropriate incrimination,and in the process of sentencing,mitigating and progressive application and enforcement of penalties should be promoted,while establishing a hierarchical mechanism for dealing with the incidental consequences of crime,and guarding against the over-restriction of misdemeanor justice.To achieve orthodontia for the tendency of doctrine of severe punishment in practice,to alleviate the triple dilemma of misdemeanour justice,to avoid the loss of the due punitive function of the criminal law,and to realize the harmonious unity of the functions of punishing crime and preventing crime.
