基层司法参与农村彩礼纠纷治理的类型化研究

摘　　要：彩礼同时具有契约属性和支付属性。根据两种属性的强弱程度不同,农村彩礼可以分为“强契约—强支付”“弱契约—强支付”“弱契约—弱支付”“强契约—弱支付”四种类型。彩礼的契约属性关乎基层法院参与农村彩礼纠纷治理的形式。其中,弱契约属性的彩礼对应法官主导型治理;强契约属性的彩礼对应多元协作型治理。彩礼的支付属性影响基层法院参与农村彩礼纠纷治理的目的。其中,弱支付属性的彩礼对应纠纷解决型司法;强支付属性的彩礼对应政策实施型司法。对不同的治理形式和目的进行组合,基层法院参与农村彩礼纠纷治理可以分为多元协作的政策实施型司法治理、法院主导的政策实施型司法治理、多元协作的纠纷解决型司法治理三种类型。The dowry has both contractual and payment attributes.According to the strength of the two attributes,rural dowries can be divided into four types:“strong contract-strong payment”“weak contract-strong payment”“weak contract-weak payment”and“strong contract-weak payment”.The contractual attribute of dowries is related to the form in which grassroots courts participate in the governance of rural dowries disputes.Among them,the dowries with weak contractual attribute correspond to judge led governance;the dowries with strong contractual attribute correspond to diverse collaborative governance.The payment attribute of dowries is related to the purpose of grassroots courts participating in the governance of rural dowries disputes.Among them,the dowries with weak payment attribute correspond to dispute resolution justice;the dowries with strong payment attribute correspond to policy implementation justice.Combining different forms and purposes of governance,the participation of grassroots courts in rural dowry dispute governance can be divided into three types:diverse collaborative-policy implementation judicial governance,court led-policy implementation judicial governance,and diverse collaborative-dispute resolution judicial governance.
