协助监管的生成与动力:理解国家监管体制的新视角

摘　　要：既有研究对国家监管体制的理解多从正式制度层面展开,协助监管构成国家监管的对立镜像,能够提供解释监管体制的非正式制度实践的视角。经验研究表明,基层的监管实践面临结构性困境,深刻地影响监管机构的行动策略,在基层政权组织的三方互动中产生强化基层监管能力的协助监管。从协助监管的发生机制看,行政化的乡—村关系为协助监管提供了组织基础,属地管理责任是协助监管的驱动机制,目标管理责任制是监管工作下沉到基层的技术手段;从协助监管的动力看,国家监管能力的提升、监管绩效的增强与压力的分担是主要形式。因此,协助监管在国家监管能力建设进程中对于国家权力深入基层社会具有重要意义。Existing studies on the national regulatory system mostly unfold from the formal institutional level,while collaborative supervision is the opposite mirror image of national supervision,which can provide a perspective to explain the informal institutional practices of the regulatory system.Starting from the structure of the national regulatory system,it is discovered that the joint action of multiple logics gives rise to the practical form of collaborative supervision.Empirical research shows that the regulatory practice at the grassroots level faces structural dilemmas,profoundly affecting the action strategies of regulatory agencies,collaborative supervision that strengthens the regulatory capacity at the grassroots level is generated in the tripartite interaction of grassroots political power organizations.From the perspective of the regulatory power space,in the process of building the national regulatory capacity,collaborative supervision is of great significance for the penetration of national power into grassroots society.
