摘　　要：当前,我国犯罪结构呈现出显著的轻罪化趋势,传统轻罪处置的简单化模式滞后于社会治理的现代化进程,轻罪行刑社会化已成为理论演进与实践发展的内在趋向。我国社会化行刑措施呈现诸多弊病,缓刑受重刑主义桎梏,适用率低且执行封闭,社会参与受阻;管制刑效能式微,惩罚与执行均显乏力,违规处置规则缺失;单科罚金刑功能失调,无限额罚金占主导地位,单处罚金适用比率较低;假释条件严苛,法律界定模糊,办案风险较大,罪犯也颇多顾虑。因此,需在观念层面倡导社会化行刑的广泛认同,重塑轻罪认知;组织层面赋能大众深度参与,完善协同工作机制;制度层面构建完备的行刑体系,优化非监禁刑适用的法律支撑;实践层面探索社会化行刑本土模式,推动行刑方式转型;管理层面塑造实效评价标准,构建多维度指标体系,以促使我国轻罪行刑社会化体系臻于完善,达致轻罪现代化治理的“大出罪”图景。The criminal structure in China is showing a significant trend towards leniency.Simplified model of traditional crime disposal has lagged behind the modernization process of social governance currently.The socialization of penalty execution of minor offences has become an inherent trend in the development of theory and practice.There are many drawbacks to socialized execution measures,such as probation being constrained by heavy punishment,low applicability and closed execution,hindered social participation,weakened regulatory effectiveness,ineffective punishment and execution,lack of standardized handling of violations,and dysfunction of single subject fines.So it is necessary to optimize mechanisms and innovate socialized execution in terms of ideology,organization and system of execution for minor crimes,realize the big picture of modern governance of minor offences.
