摘　　要：当今世界,保护人权和建立法治已经成为人类政治文明进步的重要标志。人权与法治有着密切的联系,人权是法治的基本价值和根本目标,法治是人权的根本保障,也是人权得以保护和尊重的重要标志,离开了法治,人权的保障和发展是不可能实现的。三峡工程移民由于淹没范围广,移民人数多,安置难度大,库区移民能否“搬得出、稳得住、逐步能致富”,—Nowadays in the world, protection of human rights and establishment of the society ruled by law have become a vital identification showing human advance in political rights and civilization. A close relationship exists between the human rights and the legal system. The human rights are a fundamental value and a substantial objective for the legal system, and vise versal, the legal system is a basic guarantee of human rights and also an important mark of protection and respect of human rights. It could not be possible to safeguard and develop human rights in a society without a legal system. In light of wide inundation scope, numerous population, affected by the project and difficulties in displacement and relocation, whether they can move out voluntarily from the Three Gorges reservoir, resettle down and get prosperity gradually, as a great concern of people from many aspects of the society, is a key to build up the Three Gorges project successfully. It would certainly be of significance for ensuring successful implementation of resettlement how to think and analyze the relationship between the resettlement by law and regulations and indemnity of resellers' human rights.
