摘　　要：军事代表制度是军用品采购的重要制度.军事代表行使的权力属于公共权力的委托代理,存在公共权力委托代理运行失灵问题; 针对这种公共权力委托代理运行失灵的潜在原因作了深入的剖析; 并提出了克制失灵的政策建议.Military agent regime is an important regime in the process of military material acquisition. Military agent regime is validity and necessary to supervise the contract executing, adjust the relationship between military and firms and insure the prescriptive tempo quality and price. Military agent regime belongs to the commonality power mandatory agent, so malfunction of the commonality power mandatory agent exists. This article makes a deeply analysis and gives some measures to harness this problem.
