摘　　要：在现代的公安行政管理中,公安机关享有大量的行政自由裁量权,合理行使自由裁量权是公安行政执法高质量的重要保证。“合理行使自由裁量权”要求公安执法者正确认识执法中“合法”与“合理”的关系,以合法原则为先;要求公安执法者在自由裁量权“度”的把握上应注重实现立法的目的、遵行公正公开原则的要求、考虑社会环境中正当的“情”与“理”。为保证公安行政自由裁量权的合理行使,应加强公安行政立法的严谨性和可操作性,强化公安执法者的业务素质和道德素质,建立、健全有效的公安执法监督体系。In modern public security administration,public security organs have a great deal of liberal judgment authority,therefore reasonable exercise of this authority is an important guarantee to the high quality of it.Reasonable exercise of liberal judgment authority requires the public security executors to identify the relationship between'legality'and'reasonableness'during work and to take legal principles as prerequisite.It also requires them to pay attention to object of legislation,to answer the requests of obeying fair and open principles and to consider the proper'sense'and'reason'under the social circumstances.In order to reasonably exercise the liberal judgment authority of public security administration,we should strengthen the administrative legislation to be rigorous and flexible,we should intensify public security law-executors'professional and moral quality,and should set up an effective supervisory system.
