摘　　要：针对船员劳务合同中优先权问题进行了探讨,指出在船员与船舶所有人没有劳动合同的情况下,船员仍对劳动报酬享有船舶优先权;船员劳动服务机构就船员工资及船员人身伤亡不享有船舶优先权。This paper makes a study on the maritime priority in the crew employment contract, points out that crew members should be entitled to enjoy maritime priority for their wages and other remuneration if there is no labour contract between the crew and the shipowner. It further states that the crew labour service organization should not be entitled to enjoy maritime priority for crew’s wages and damages to the loss of life or other personal injury suffered by the crew.
